CIPAA, Arbitration, and Litigation are the three primary mechanisms used in the construction industry to recover outstanding fees and resolve payment claims, operating under a fast-to-slow spectrum of speed, cost, and finality. CIPAA provides a rapid statutory interim solution, Arbitration offers private final resolution, and Legal Proceedings (Litigation) deliver comprehensive judicial enforcement.
CIPAA Adjudication (Fast-Track Recovery)
- Definition: Governed by the Construction Industry Payment and Adjudication Act 2012 (CIPAA) and administered via bodies like the Asian International Arbitration Centre (AIAC), it functions on a "pay now, argue later" principle.
- Timeline: Roughly 95 to 100 working days from claim to a binding decision.
- Scope: Strictly limited to monetary payment disputes (progress claims, final accounts, retention sums, consultancy fees) under written or oral construction contracts.
- Enforceability: Decisions are binding immediately; unpaid parties can register the decision in the High Court to enforce it like a formal judgment, or invoke direct payment from a project principal/developer under Section 30.
Arbitration (Private & Final Resolution)
- Definition: A consensual, private dispute resolution process triggered by an arbitration clause inside a construction contract.
- Timeline: Several months to years depending on case complexity, document discovery, and expert witness cross-examinations.
- Scope: Comprehensive; covers all dispute types including project delays, design defects, liquidated damages, variations, and contract termination.
- Enforceability: Produces a final and binding award enforceable internationally under the New York Convention.
Court Litigation / Legal Proceedings (Litigation)
- Definition: Public court-based civil proceedings handled through the judicial system.
- Timeline: Often the slowest path due to heavy court backlogs and potential multi-tier appeals.
- Scope: Widest jurisdictional scope, allowing third-party joinder (bringing in multiple contractors, guarantors, or architects at once) and complex tort or negligence claims.
- Enforceability: Delivers ultimate legal remedies, including freezing injunctions (Mareva orders), but exposes details to the public record.
